Woman Dies From Traumatic Brain Injuries Suffered in Portsmouth, VA Car Crash

The fatal Nov. 19, 2012, accident occurred at the intersection of Portsmouth Boulevard and Martin Avenue after one driver turned into the path of the other.

By Shapiro, Lewis & Appleton, Fatal Brain Injury Attorneys

An early morning car crash in Portsmouth, Virginia (VA), on Nov. 18, 2012, left one woman dead from traumatic brain injuries. According to police reports cited by the Virginian-Pilot, the fatal accident occurred when the driver of an Oldsmobile turned into the path of a Kia. The Kia flipped over after the collision.

No charges have been filed, as law enforcement personnel continue to try to determine whether the turning driver failed to yield right of way or whether actions by the woman who lost her life contributed to causing the collision. The person behind the wheel of the Oldsmobile was not injured.

The Virginia Brain Injury Lawyers’ Perspective

Traffic accidents are a leading cause of TBIs, and those head and brain injuries too often prove deadly. This is especially true when a vehicle rolls over or winds up on its roof. Even when drivers and passengers are wearing seat belts or, if they are children, strapped into safety seats, people in a rolling car or truck have little head protection.

If investigators find that the Oldsmobile driver caused the Kia to flip over, the deceased woman’s family may have grounds for filing a wrongful death claim.

Virginia Beach Teen Still Fighting for Life after Car Wreck Caused by Racing

by Rick Shapiro, Virginia Brain Injury Attorney

What Happened:

Everyone knows car racing should be done on a track, with the proper equipment and safety guidelines. But sometimes, when a couple of teens find themselves next to each other in cars with engines revving, common sense goes out the window and the race is on. Unfortunately, this inability to say “no” almost cost one teen passenger his life. The car wreck occurred on September 9, 2012 on Lynnhaven Parkway near Lishelle Place, in Virginia Beach, VA. The car the victim was riding in left the road, hit some trees, and re-entered the road where it hit the other car it had been racing.

The Virginia Injury Lawyer’s Perspective:

The car crash left the 16-year-old passenger with numerous broken bones, collapsed lungs, and a major brain injury. Perhaps the most serious of all the injuries, the traumatic brain injury has left the victim with amnesia. He isn’t even able to recognize his own family. With brain injuries like his, only time will tell if he regains his memory and other cognitive abilities. If not, he may require a lifetime of care. Our experienced VA brain injury attorneys have helped several car accident victims with this type of injury receive the compensation they need to cover not only their current expenses, but also future expenses, such as lost wages due to the inability to work, the cost of special schooling if necessary, and future medical costs.

Teen Suffers Traumatic Brain Injury in Campbell County, VA Car Crash

On August 30, 2012, two friends were riding in a car in Campbell County, VA. According to the driver of the car, another car came up next to them, ran them off Gough Road, and drove away.

The driver was not seriously hurt in the car crash, but her passenger was taken immediately to Roanoke Memorial Hospital, where she remains with a traumatic brain injury. Our thoughts are with the victim and her family and we hope she has a full recovery.

Traumatic brain injuries can vary in severity from symptoms such as temporary memory loss to seizures, or the inability to walk, talk, or care for oneself on a daily basis. Our Virginia traumatic brain injury law firm has helped victims who have suffered this tragic type of injury, including one child who was injured when a truck rear-ended her family’s car. Our attorneys were able to secure a settlement for her that will pay out about $21 million throughout the course of her life for medical bills and additional needs.

In the current case, in addition to facing the uncertainty of their child’s future, the victim’s family must also try to follow the ensuing investigation into what really caused the car wreck. We would recommend that they contact an experienced VA car accident attorney who will keep on top of the investigation and assist with any insurance claims or legal action that needs to be taken.

Fatal Brain Injury Suffered by Bike Rider in Chesapeake, VA

The accident occurred on Bainbridge Boulevard at an on ramp to Military Highway, and the car was driving in the same direction as the bicyclist.

By Randy Appleton, Traumatic Brain Injury Attorney in Virginia

A collision with a car on Bainbridge Boulevard in Chesapeake, Virginia (VA), left a bicyclist with a fatal traumatic brain injury. According to the Virginian-Pilot, the accident occurred at the on ramp to Military Highway, and the car was driving in the same direction as the bike rider before the bicyclist hit the side of the vehicle.

The man thrown from the bicycle was declared brain dead at Sentara Norfolk General Hospital, and his family has agreed to have his organ donated.

View a larger map of the Bainbridge Boulevard intersection where a bike rider died after colliding with a car in Chesapeake, VA.

The newspaper did not indicate whether the 20-year-old who lost his life was wearing a helmet, but the detail about the driver following the bicyclist is potentially telling. While police have not filed charges in relation to the wreck, the only way it seems possible for a bike rider to hit the side of a car that had been behind him was if the car’s driver turned in front of the bicyclist.

No one can know for sure whether that is what happened until the police complete their investigation into the deadly accident. Still, as a Virginia personal injury and wrongful death attorney who has helped many victims of car accidents, I know that far too many bicyclist, motorcyclists and scooter riders are hit and injured or killed by drivers whose only explanation is “I didn’t see them.” That is never an acceptable excuse.

Motorcyclist Suffers Critical Brain Injury in Newport News, VA Crash

The driver of the car the motorcyclist hit was traveling toward the bike rider and attempted to make a left-hand turn just before the accident.

By Jim Lewis, Virginia Attorney for TBI Victims

A collision with a car on Jefferson Avenue in Newport News, Virginia (VA), left a motorcycle rider hospitalized in critical condition with a traumatic brain injury. The accident occurred at around 9:30 pm on April 27, 2012, near the intersection with Hogan Drive.

Police continue to investigate the crash, but officials told reporters that the driver of the car the motorcyclist hit was traveling toward the bike rider and attempted to make a left-hand turn just before the accident. Left for police to determine is whether the motorcyclist was speeding or operating unsafely, or whether the person behind the wheel of the car failed to yield right of way.

Media reports did not indicate whether the motorcyclist was wearing a helmet.

What is undeniable, though, is that yet another motorcycle rider wound up with a TBI after a car or truck turned in front of him. As a Virginia personal injury attorney who has assisted victims of motorcycle accidents and brain injury victims, I have seen too often the terrible aftermath of collisions resulting from drivers failing to watch out for people on bikes when turning or changing lanes.

I wish the biker hurt in this crash a full and speedy recovery.

Study Shows Teen Drivers Suffer High Percentage of Brain Injuries in Crashes

By Kevin Duffan, Personal Injury Attorney

A new study conducted by State Farm Insurance and the Children’s Hospital of Philadelphia has found that teens in car accidents are very likely to receive serious head injuries. In fact, 30% of the 550,000 teens surveyed showed they and their passengers suffered head injuries including skull fractures and concussions when they were in car accidents.

This revelation only further cements the knowledge that teenagers are in great danger behind the wheel. Most literature on teen car accidents indicate that car wrecks are the single highest killer of teenagers. The study concluded that stronger laws are needed to protect teens behind the wheel. With one in three teens diagnosed with a head injury following a car accident, parents need to do whatever it takes to protect their kids.

If your child has been involved in an accident, don’t take their complaints of headaches lightly. Too often, people underestimate the dangers associated with whiplash. If your teen has been injured in a wreck, visit your doctor and demand an MRI or CT scan to investigate a head injury. It’s the only real way to know for sure if your child has been injured. As a Norfolk injury attorney, I know just how quickly a crash can turn deadly or affect a life for years after. Give us a call, and we’ll help you explore all your options. Our experience and expertise will be invaluable in the courtroom. Don’t wait – call today for a free consultation.
